GENERAL CONDITIONS OF SALE

 

1. General

These general conditions of sale govern the relationship between, on the one hand, YUMMY BAK' ORIENT, whose registered office is located at 15 avenue des Lilas 13015 Marseille, and whose Siret number is being created, operating under the name "Yummy Bak' Orient E-Boutique", hereinafter referred to as "the Seller", and, on the other hand, the natural or legal person who places a remote order (by means of an online order, via the website www.yummybakorient.com), in its own name or on behalf of third parties, both for professional and private purposes – hereinafter referred to as "the Customer". Depending on the particular situation of the Customer (consumer or not), certain clauses of these general conditions may not be applicable to him.

The company YUMMY BAK' ORIENT, offers the Customer the sale of products online under the name of "Yummy Bak' Orient E-Shop".

The Client declares to have full legal capacity.

2. Object

The products are described on the site www.yummybakorient.com in good faith and as accurately as possible. The Customer always has the possibility to obtain additional information on the products presented on request to the e-mail address contact@yummybakorient.com, by telephone at 0766050164. The presentation of the products does not bind the Seller and does not constitute an offer within the meaning of the civil law of the term.

Photographs, video films illustrating the products, do not fall within the scope of the contract. If errors are introduced, in no case, the responsibility of the Seller may be engaged.

3. Ordered

The products offered in the Yummy Bak' Orient E-Boutique are those appearing on the site on the day of its consultation by the Customer and within the limits of available stocks.

The Customer can read the various products offered by the Seller on its website www.yummybakorient.com. The Customer can browse freely on the different pages of the site, without being committed to an order.

The products are presented by means of an information sheet (product description, composition, allergens, photo and price) developed with the maximum accuracy and precision in order to allow a description of the most faithful and complete. The food products sold on the site www.yummybakorient.com contain certain allergens specified for each product under the heading "Composition". However, given the digital presentation of the products on the Internet, it is possible that the Customer's perception of the photographic representation of the products does not correspond exactly to the product itself.

The Customer will then select the desired products and their quantity. The products will be automatically added to the Customer's shopping cart.

The order of a product appearing on the site may be accompanied by the registration of a customer account, by clicking on "I wish to create my account". The Customer must fill out a form in this regard. In addition, the Customer must provide his email address and a password of his choice which will be personal and confidential and which he will need to identify himself later on the site. The Customer accepts that the entry of these two identifiers is proof of his identity and expresses his consent to these general conditions of sale.

At any time, the Customer may obtain a summary of the products he has selected, by clicking on "View cart", correct any errors made in the entry of the order data, complete his selection of products and order the products by clicking on "Order".

The Customer may choose the method of payment he wishes according to the terms provided for in Article 6.

As soon as he clicks on "Buy", the Customer definitively validates his order: the order is registered and the sale is definitively concluded. The Customer can no longer correct any errors made in the entry of the order data.

The contract is deemed concluded upon confirmation by e-mail and implies unreserved acceptance of these general terms and conditions.

The purchase order will be recorded on the Seller's computer records, themselves kept on a reliable and durable medium, and will be considered as proof of the contractual relations between the parties. It is also valid with regard to the availability and price of the items.

Automatic registration systems are considered as proof of the nature, content and date of the order. The sale will only be concluded from the confirmation of the order sent to the Customer by e-mail.

The Seller reserves the right to make the order subject to other conditions, to suspend or refuse it, in particular if the order proves to be incomplete, if the data communicated is manifestly incorrect, in case of non-payment of previous orders, or for any other reason at the discretion of the Seller.

The information provided by the Customer, when taking the order binds him: in case of error in the wording of the customer's contact details, the Seller can not be held responsible for the impossibility in which it could be to make the delivery.

Orders are final only when they have been confirmed by the payment of the order by the Customer.

4. Price

The prices of the different products are indicated in Euros (€), all taxes included. Prices are deemed net, excluding shipping costs. The Seller reserves the right to change prices at any time. However, the products will be invoiced in Euros on the basis of the rates in force at the time of registration of the order, subject to availability. The placing of the order implies acceptance of the price indicated for the chosen product.

Shipping costs, if any, are specified separately when you place an order and must also be paid at the time of ordering.

In the order confirmation, the total amount is the final price, expressed all taxes and fees included.

5. Customs duties

Any order placed on the site and delivered outside the France may be subject to possible taxes and customs duties that are imposed when the package reaches its destination.

These customs duties and any taxes related to the delivery of an item are exclusively the responsibility of the Customer and is his responsibility. The Seller is not obliged to verify and inform the Customer of applicable customs duties and taxes. To know them, the Seller advises the Customer to inquire with the competent authorities of his country.

6. Payment terms

The site of the Yummy Bak' Orient E-Boutique is under French law, and the items offered on the site are all shipped from France. Invoices are established in Euro, subject to the French Value Added Tax (VAT) which is 5.5% and transport costs subject to 20%.

Any order shipped to a country of the European Union outside the France, is subject to the VAT of the country of shipment and according to the thresholds authorized by the European Union.

The Seller accepts the following payment methods: VISA, MASTERCARD, PayPal. The Customer will receive confirmation of receipt of payment of the price by e-mail.

Regardless of the payment method chosen, the order will only be taken into account once validated. As long as an order is not validated, it remains recorded but is not taken into account. The validation of the order is issued once the debit authorization has been sent by the payment verification and validation body. It is at this time that the Seller will send a confirmation email and the Customer will be charged.

The Seller guarantees the total confidentiality of banking information, secured by the SSL protocol, which automatically controls the validity of access rights when paying by credit card and encrypts all exchanges to guarantee confidentiality.

7. Proof of transaction

In general, the parties accept electronic means of evidence in the context of their relations (e-mail, etc.).

The parties agree that the data recorded by the Seller constitute proof of all transactions made on the site by the Customer. The data recorded by the payment system constitutes proof of financial transactions.

8. Implementing rules

Orders are processed from Monday to Friday excluding public holidays. Packages are sent from the France, within 1 to 2 working days of payment of the order, except in cases of force majeure.

The Seller declines all responsibility for late delivery or failure to deliver in the event of force majeure or events beyond its control, which would make the execution of the agreement impossible or more onerous in whole or in part, or in case of the fact of third parties, such as the suppliers of the parties hereto, or failing that the Customer respects its commitments.

Are considered as cases of force majeure relieving the Seller of its obligation to deliver, war, riot, fire, strikes, accidents and the impossibility of being supplied. The Seller will keep the buyer informed in a timely manner of the cases or events listed above.

In any case, the delivery of the products on time can only occur if the Customer is up to date with his obligations towards the Seller. In addition, the deadlines are indicated in good faith in the order or its summary and have only an indicative value. The deadlines are therefore not in themselves an essential condition of the contract and the Seller will not be liable for any compensation or the payment of interest in the event of delay in the performance of its obligations.

The Customer may also modify the date set, in compliance with the conditions set out in the confirmation e-mail, either on the website www.yummybakorient.com, or by contacting customer service at the address contact@yummybakorient.com, and this subject to the assumption of any costs and cost changes related to this change of date.

Products purchased on the site www.yummybakorient.com are delivered to the delivery address indicated by the Customer. The Seller cannot be held responsible for the consequences of the Customer's errors when placing an order.

The Seller cannot also be held responsible for the non-performance of the contract concluded in the event of force majeure, disruptions, partial or total strikes including means of transport and transport services.

  1. RIGHT TO RETRACT

Returns do not apply to contracts for the supply of food products marketed on the merchant site www.yummybakorient.com. These goods received by the Customer after delivery cannot be returned for reasons of hygiene or health protection.

The return of the product is only accepted for quality reasons. If necessary, we kindly ask you to send us an e-mail to customer service at the contact@yummybakorient.com address accompanying the request with photos of the product and packaging. The return is only possible 7 working days after receipt of the package.

The products must be returned within 7 days of notification to the Seller of the Customer's decision to withdraw, in their original packaging and in perfect condition allowing them to be remarketed in new condition. Damaged, soiled or incomplete products will not be taken back. In case of exercise of the right of withdrawal within the aforementioned period, only the price of the product (s) purchased and the delivery costs will be refunded; the return costs remaining the responsibility of the Customer. The exchange (subject to availability) or refund will be made within 7 days of receipt by the Seller of the products returned by the Customer under the conditions of this article.

10. Availablity

Offers are offered within the limits of product availability. In case of unavailability after placing the order, the Seller undertakes to inform the Customer by telephone or email as soon as possible. The Customer may then request the cancellation of the order. The Customer will, if necessary, be reimbursed by crediting his bank account no later than fifteen days of cancellation.

 

 

11. Intellectual property

All texts, comments, illustrations and images reproduced on our site are reserved under copyright and intellectual property. Any total or partial reproduction without the agreement of the Seller is strictly prohibited. The order entails no assignment or concession of intellectual rights unless expressly stated.

12. Responsibilities

The products offered comply with the French and European legislation in force. The Seller cannot be held liable to the extent that it has performed its services in accordance with the requirements of these regulations.

Any complaint must be addressed in writing, without delay by e-mail to contact@yummybakorient.com. If it appears, within thirty days of receipt of the complaint, that the Seller has breached its obligations, the latter will make at its own expense a new delivery of the products that are the subject of the complaint.

13. Transfer of ownership

The Yummy Bak' Orient E-Boutique retains full ownership of the products sold until full receipt of all sums due by the Customer as part of his order. The transfer of ownership of a property purchased by the Customer to a third party will not be supported. Only the original Customer of this property can claim access to the clauses of these general conditions of sale.

14. Privacy

The personal data provided by the Customer are necessary for the processing of his order and the establishment of invoices. They may be communicated to the seller's partners responsible for the execution, processing, management and payment of orders. In accordance with the Data Protection Act of 6 January 1978, the Customer has a right of permanent access, modification, rectification and opposition with regard to information concerning him. The Customer may exercise this right by sending an email to customer service at the following address: contact@yummybakorient.com, including his surnames, first names, email and customer reference, accompanied by a photocopy of an identity document bearing his signature. A response will be sent within 2 months of receipt of the request.

16. Claim – Litigation

Claims or disputes will always be received with attentive benevolence, good faith being always presumed in the one who takes the trouble to expose the dispute.

Upon receipt of the products, the customer must ensure the conformity of the delivery with his order. Any damage must be the subject of precise reservations, dated and signed, on the delivery note.

Orders notified as being "delivered" by the carrier will not be able to be refunded.

Any complaint must be made within 7 working days after receipt of the order, to the customer service of YUMMY BAK' ORIENT:

In the event of a dispute, an amicable solution will be sought as a priority before any legal action. To this end, we kindly ask our customers to contact our customer service by phone or email at the following address: contact@yummybakorient.fr. In the absence of an amicable solution, any legal action will be brought before the competent courts.

17. Warranties

The shelf life (best before date) of our baklava is indicated under each box, knowing that our boxes have a minimum life of 15 days to 20 days maximum.

Also, in order to better appreciate our products, we advise you to choose the delivery date closest to your consumption date.

The Yummy Bak' Orient e-boutique site guarantees the quality and freshness of its products provided they are kept in a cool place (between 14 and 18 ° C), protected from light in their original packaging.
